With the recent mobilization of more than 3,500 members of the Texas National Guard, many businesses in Texas are dealing with the temporary loss of employees. While this affects large and medium size businesses, it is most difficult on small business. Small companies often do not have the personnel necessary to fill in for colleagues who are away. And with the current economic climate most businesses are operating with fairly tight staffs as it is.

Companies that think they can simply replace the absent employee with a new permanent hire should know that there is a law that prevents companies from doing so. The Uniformed Services Employment and Reemployment Rights Act (USERRA), enacted October 1994 and significantly updated October 1996 and 1998, provides protection and rights of reinstatement to employees who participate in the National Guard and Reserve.
